Nursing Homes

The growth of nursing homes and assisted living centers in the Commonwealth of Pennsylvania has concurrently fostered increased attention from risk managers and legal counsel with respect to professional and premises liability issues. As a result, this niche practice requires defense counsel who are uniquely prepared and sensitive to representation of this industry.
In the 1980s, Mr. Cipriani developed and owned several assisted living homes and was responsible for the creation and maintenance of administrative policies and procedures. This required knowledge of Pennsylvania legislation and administrative supervision through the Pennsylvania Department of Welfare and other state and federal licensing agencies. It also required extensive knowledge in the administrative litigation process available to this industry.
In addition to this firsthand experience, the firm has developed relationships with both institutional owners and insurers, providing legal counsel in workers’ compensation and casualty arenas as well. Additionally, the firm employs attorneys who are nurses, or have represented medical for decades, allowing us to converse in the language of healthcare.
Issues typically include the appropriateness of restraints, the level of care required for the particular resident, the quality of admitting information, as well as ongoing charting, premises maintenance, the quality and quantity of professional and support staffing, the quality of custodial and medical care rendered to the resident, and the quality of supervision provided to the residents.
Injuries have included decubitus, scaldings, elopement, insufficient medical care, abuse, and abandonment. The unusual nature of this practice requires particular sensitivity to the advancement of a medical malpractice case using simple negligence principles.
