Attorney Shenk Secures Nonsuit in Wrongful Death Action

Lois M. Shenk, a partner in the firm’s Philadelphia office, secured a nonsuit for a member of the LLC which operated a nursing home facility.

Days before jury selection in a medical malpractice case filed in the Philadelphia Court of Common Pleas, Attorney Shenk was retained to represent a member of the LLC which operated a nursing home facility.  This was a wrongful death/survival action wherein the Estate alleged the death of a nursing home resident was caused by an infection from a pressure wound.  Plaintiff argued that the corporate veil of the LLC should be pierced to allow for individual or direct liability of the member of the LLC.

The case was tried before a jury and at the conclusion of Plaintiff’s case, Attorney Shenk was successful in arguing to the Court that Plaintiff failed to present sufficient evidence to pierce the corporate veil.  Although the issue was hotly contested by the Plaintiff, the Judge agreed with the defense and granted a nonsuit for the member of the LLC.  The jury trial continued as to the remaining defendants.
